These Terms of Service ("Terms") govern your access to and use of SkillFrame (the "Service") operated by us. By creating an account, accessing the site, or using any part of the Service, you agree to these Terms.
If you do not agree, do not use the Service.
The Service
SkillFrame provides photography practice tools, including assignments, feedback, and related features. Features and availability may change. We may run tests or experiments (for example, variations of flows or copy) to improve the product; continued use may include participation in those improvements unless we notify you otherwise where required.
Eligibility
You must be old enough to enter a binding contract in your jurisdiction and not barred from using the Service under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
Accounts and security
You are responsible for safeguarding access to your account and for activity under your account. Notify us promptly of unauthorized use.
Your content
You retain rights to photographs and other materials you upload ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and create derivative feedback (including via automated and AI-assisted means) solely to operate, improve, and promote the Service, subject to our Privacy Policy.
You represent that you have the rights needed to upload User Content and that it does not violate law or third-party rights. Do not upload unlawful, infringing, or harmful content.
AI-generated feedback
Critiques and related outputs are generated using automated systems and may be inaccurate or inappropriate. They are educational suggestions, not professional advice. You use AI outputs at your own risk.
Subscriptions and payments
Paid features, if offered, are billed through Stripe (or another processor we designate). Fees, renewal, and cancellation terms are presented at checkout and may change for new purchases. Taxes may apply. Unless stated otherwise, subscriptions renew until you cancel according to the instructions we provide.
Acceptable use
You agree not to misuse the Service, including: probing or breaching security; scraping or automated access that overloads our systems without permission; reverse engineering except as permitted by law; using the Service to violate law or others' rights; or uploading malware.
We may suspend or terminate access for violations.
Third-party services
The Service integrates third parties (for example, Supabase, OpenAI, Stripe). Their terms and privacy policies also apply to their services.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM THESE TERMS OR THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT HAD SUCH PAYMENT OBLIGATIONS.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
Indemnity
You will defend and indemnify us against claims arising from your User Content or your violation of these Terms, to the extent permitted by law.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless mandatory consumer protections in your country say otherwise. Courts in Delaware have exclusive jurisdiction for disputes, except that you may also have rights to bring claims in your local courts where required by law.
Changes
We may modify these Terms by posting an updated version on this site. If a change is material, we will take reasonable steps to notify you (for example, by email or a notice on the Service). Continued use after the effective date constitutes acceptance of the revised Terms where permitted.
